Welcome to Toneful! These Terms of Service ("Terms," "Agreement") govern your access to and use of the Toneful Chrome extension, website, and related services (collectively, the "Service"). This Agreement is a legally binding contract between you ("you," "your," "user") and Toneful ("we," "our," "us").
BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. If you do not agree with any part of these Terms, you must not use the Service.
Please read these Terms carefully before using Toneful. These Terms contain important information about your legal rights, remedies, and obligations, including mandatory arbitration and class action waiver provisions in Section 12.
Toneful is an AI-powered email communication assistance tool designed to help you articulate your thoughts clearly in email and messages. Our Service includes:

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes affecting your use of the Service.
You must be at least 13 years old to use Toneful. If you are under 18 years old (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian to use the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
You may only create and maintain one account. Creating multiple accounts to circumvent usage limits or for any other purpose is prohibited and may result in termination of all accounts.

We reserve the right to change our pricing at any time. For existing subscriptions, you will receive at least 30 days' notice of any price increase. Price changes will take effect at your next billing cycle after the notice period. You may cancel your subscription before the price increase takes effect.
All payments are processed securely through Stripe, our third-party payment processor. We do not store your credit card information on our servers.
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate.
If payment fails, we will notify you via email and attempt to re-process payment up to 3 times over 7 days. Your account may be downgraded to Free tier if payment cannot be processed. You will retain access to previously purchased Expert Packs.
7-Day Money-Back Guarantee:
After 7 Days: Personal subscriptions are non-refundable. You may cancel at any time to prevent future charges, and access continues until the end of your current billing period.
7-Day Return Window:
To request a refund, email support@toneful.io with "Refund Request" in the subject line. Include your account email address and reason for refund. Refunds will be processed within 5-10 business days to the original payment method.
You may cancel your Personal subscription at any time through Settings > Subscription. Cancellation takes effect at the end of your current billing period. You retain Personal access until the end of the paid period, then your account automatically reverts to the Free tier. Your transform history and purchased Expert Packs are retained.
Important: Expert Pack discount (50% off) will no longer apply to future purchases after cancellation.
You may permanently delete your account through Settings > Account > Delete Account. This action is permanent and cannot be undone. Account deletion results in immediate loss of access and permanent deletion of all account data within 30 days, including transform history and purchased Expert Packs (no refunds). Active subscriptions should be cancelled first to avoid charges.
We reserve the right to suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, abuse the Service, attempt to circumvent usage limits or payment systems, or if required by law.
You agree NOT to use Toneful to:
While Personal tier offers unlimited transformations, this is subject to fair use. Typical fair use is expected to be under 1,000 transformations per day. Automated, systematic, or bulk processing that is inconsistent with typical human usage patterns may result in account throttling or termination.
The Service, including software, code, algorithms, Chrome extension, website design, Toneful brand name and logo, Expert Pack content, and all related intellectual property, is owned by Toneful and protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.
You retain all ownership rights to message fragments you input into Toneful, your original ideas and communications, your transform history, and any personal data you provide.
The message suggestions generated by Toneful are provided "as-is" without warranty of any kind. They are tools to assist your communication and are not guaranteed to be accurate, appropriate, or suitable for your specific situation.
Important: You are solely responsible for reviewing AI-generated suggestions before using them, ensuring the final message content is appropriate and accurate, and any consequences arising from messages you send based on Toneful's suggestions.
Toneful is a tool to assist communication, not a replacement for your judgment.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee that the Service will be uninterrupted, secure, error-free, or that AI-generated content will be appropriate for all contexts.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TONEFUL SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. In no event shall our total liability exceed the amount you paid to Toneful in the 12 months preceding the event giving rise to liability. For Free tier users, our total liability shall not exceed $50.
You acknowledge that AI-generated content may contain errors, inaccuracies, or inappropriate suggestions. You are responsible for reviewing and editing AI suggestions before use. We are not liable for consequences arising from use of AI-generated content.
You agree to indemnify, defend, and hold harmless Toneful from any claims, liabilities, damages, losses, costs, or expenses arising from your use or misuse of the Service, violation of these Terms, violation of any rights of another party, content you input into the Service, or messages you send based on AI-generated suggestions.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
You agree that any legal action or proceeding relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in Delaware.
TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
You agree that any claim or cause of action arising out of or related to use of the Service or these Terms must be filed within one (1) year after such claim or cause of action arose, or it will be forever barred.
We may update these Terms from time to time. Material changes will be communicated via email and in-app notification at least 30 days in advance. Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree to the new Terms, you must stop using the Service and may delete your account.
Toneful provides a communication assistance tool and does NOT provide legal advice, professional writing services, counseling, or business consulting. You should seek appropriate professional advice for specialized needs.
By using the Service, you consent to receive electronic communications from us, including emails, in-app notifications, and updates. You agree that all agreements, notices, and communications provided electronically satisfy any legal requirement that such communications be in writing.
